Summary:
This lectureship reviews the relevant case law developed by the Texas Appellate Courts regarding the exploration and production of oil and gas in this state. It then applies the principles garnered from these case decisions and any existing statutory law to the negotiation of an oil and gas lease to best benefit a mineral owner's interest.
Learning Objectives:
• Become familiar with the Rule of Capture as applied by Texas courts to the exploration and development of oil and gas.
• Learn the application of real property laws that apply prior to capture and the personal property laws that apply after capture.
• Develop knowledge of the physical parameters regarding depth to which mineral ownership extends and how drainage is legally possible in Texas from nearby properties.
• Realize and recognize that the mineral estate is dominant over the surface estate when it comes to the exploration and production of oil and gas, and the consequences this has on surface owners who have no mineral ownership.
• Grasp the legal significance of the clauses contained in a Producers SS Lease Form (the standard form used to lease minerals in Texas) and understand how to negotiate provisions to offset any adverse consequences these clauses may have on mineral owners.
• Learn how to use the Railroad Commission of Texas' web site to analyze how successful oil companies have been in the state and how to check production records on individual wells.
• Meet with a leading producer of oil and gas in South Texas to learn about how he finds and develops an oil and gas prospect.
• Provide an open forum to ask pertinent questions regarding oil and gas exploration and production in this state both from an attorney and producer.
